Terms of Service

These terms explain what you can expect from Guayaba Education LLC and what I expect from you. I've written them in plain English on purpose. If anything is unclear, write to hello@guayabaeducation.com.

Who I am

I'm Alejandro Hernández, a Spanish teacher, and Guayaba Education LLC is my business, based in Massachusetts, United States. "I," "me," and "my" in these terms means Guayaba Education LLC; "you" means the person using my services.

What I offer

My services are an essay-evaluation web app at app.guayabaeducation.com and digital curriculum products. The app scores Spanish Language & Culture and Spanish Literature & Culture essays against detailed rubrics and returns written justification and feedback.

Evaluations are drafts, you have the final say

The app produces draft evaluations to save you time. It is not the grader of record. You are responsible for reviewing every evaluation and deciding the final grade. Do not treat an automated evaluation as a final grade without your own review.

Your account

Some features require an account. Your account stores your email address, which I use to sign you in and to communicate with you about the service. Keep your password private, and tell me if you think someone else has access to your account.

Students and minors

Teachers may have their students use the app as part of coursework. If you're a student, use the services as directed by your teacher or school. If you're under 18, use the services only with the knowledge and permission of your teacher, school, or parent or guardian.

Free tier and paid plans

  • The free tier includes a limited number of evaluations per month.
  • The Teacher plan is priced by class size and includes 4 evaluations per student per month, up to a plan maximum of 400 evaluations per month. If your school or department needs more, write to hello@guayabaeducation.com.
  • Plans include a monthly allowance of audio transcriptions (10 on the free tier, 100 on the Teacher plan).
  • Paid plans are billed as subscriptions through Stripe, my payment processor. I never see or store your card details.
  • You can cancel anytime from Manage subscription in your account. Your plan stays active through the period you've already paid for, and you won't be charged again. Annual plans stay active through the end of the paid year and are not prorated on cancellation.

Digital product purchases

Curriculum products in my shop are one-time purchases, processed by Stripe, and delivered digitally right after payment. Prices are in U.S. dollars; any applicable sales tax is calculated at checkout. Because you receive the full product immediately, these purchases are final. If something isn't working with your download or access, write to hello@guayabaeducation.com and I'll make it right.

Acceptable use

Use the services only for their intended purpose: evaluating student writing and teaching. Don't attempt to break, overload, or reverse-engineer the services, don't submit content you have no right to submit, and don't use the services to violate anyone's rights or any law, including student-privacy laws that apply to you as a teacher or school. If an account breaks these terms, for example by abusing the free tier or misusing the services, I may suspend or close it.

Student work and your content

Essays and other content you submit remain yours (or your students'). You give me permission to process that content only as needed to run the service, for example sending essay text to my evaluation engine to produce scores and feedback. See the Privacy Policy for details on how content is handled.

My content

The site, the app, and my curriculum products belong to Guayaba Education LLC. Curriculum products you purchase are licensed for use in your own teaching; please don't resell or redistribute them.

Service availability

I work to keep the services reliable, but I can't promise they will always be available or error-free. I provide the services as they are, and to the extent the law allows, I am not liable for indirect damages arising from their use. My total liability for any claim is limited to what you paid me in the twelve months before the claim.

Changes

I may update these terms as the services evolve. If I make a meaningful change, I'll update the date at the top of this page. Continuing to use the services after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States.
